Formula

Hourly rate = Monthly salary ÷ (Working days × Hours per day)

Overtime pay = Hourly rate × Multiplier × Overtime hours

Section 59 of the Factories Act requires overtime at twice the ordinary rate of wages for covered workers.

Worked example

A ₹30,000 salary over 26 days of 8 hours gives ₹144.23 per hour. Twelve overtime hours at double rate add ₹3,461.52, taking the month to ₹33,461.52.

Overtime rules and wage register hygiene

Overtime pay in India is statutory, not discretionary. Section 59 of the Factories Act requires wages at twice the ordinary rate for hours beyond nine in a day or forty-eight in a week, and state Shops and Establishments Acts apply comparable rules to offices, shops and hotels with their own daily and weekly limits.

The ordinary hourly rate comes from monthly wages divided by the standard days and hours in a month, which is why the standard month you use matters. Twenty-six days of eight hours is the common convention for workers covered by the Factories Act. Whether allowances form part of the ordinary rate depends on the applicable rule, so keep the basis consistent across payroll periods and document it.

Overtime hours are capped as well as priced. Many states allow around fifty hours per quarter, with variations under state amendments, and inspectors examine the muster roll and overtime register together. Recording hours as they are worked and paying at the correct multiplier the same month is far cheaper than reconstructing a year of records during an inspection.

Payroll practices that keep you compliant

  • Maintain the overtime register alongside attendance, not at month end from memory.
  • Check your state's Shops and Establishments rules — they differ from the Factories Act.
  • Show overtime as a separate line on the payslip rather than merging it into gross.
  • Remember managerial and supervisory staff are generally outside statutory overtime.
